Director of Public Prosecutions (DPP) Ishmael Wadi may drag to court UDF heavyweight and Member of Parliament for Zomba Thondwe Dumbo Lemani alongside his two aides Thom Chiumia and Ken Ndanga in an assault case involving human rights activist Emmie Chanika if the facts of the case implicate the former minister.
A highly placed source in the office of the DPP said Wadi asked for the case file Monday and is studying the facts to determine the fate of the flamboyant politician who former DPP Fahad Assani spared from prosecution.
“The DPP is studying facts of Chanika’s case and has since asked the court to give him time to thoroughly study the file and if need be beef up the facts for prosecution,” said the source who sought anonymity.
Wadi confirmed in an interview that he is studying the facts of the case so that he can take it to court, saying that he has since asked the court to adjourn the case from this morning to August 22.
“I am studying the file right now to establish facts of the case to determine who I should prosecute in this matter. The case was supposed to come to court on 21-22 July 2004 but I have requested an adjournment in order for me to fully prepare for the case. I want to come up with proper facts of the case,” he said.
Chanika was reportedly assaulted in full view of the police after the Electoral Commission announced general election results on May 23 allegedly after picking a quarrel with Lemani.
Cilic earlier last month filed a legal battle against Lemani, Chiumia, Ndanga and the police over the beating of Chanika while Human Rights Consultative Committee (HRCC) took an advocacy role by petitioning President Bingu Mutharika to dismiss Inspector General of Police Joseph Aironi, accusing him of failing to manage and reform the Malawi Police Service.
HRCC also demanded an immediate arrest of Lemani and his two aides and threatened to take the police to task if no action was taken.
But Assani was quoted as saying Lemani had no case to answer but that Chanika would be dragged to court for defaming Lemani.
