Authoritative Northern Region Football League (NRFL) head Julius Mithi has threatened five members of his committee with legal action for their decision to suspend him which he claims is not in line with the league’s constitution.
Mithi, through his lawyers Crown and Duke, is also demanding an apology from the five colleagues namely Lovemore Kawunga Nyirenda, Patel Kaunda, Helton Gondwe, Fumbani Gondwe and David Tembo for “serious, baseless, malicious and defamatory” allegations against him.
In a letter dated January 30, 2004, signed by lawyer Dave Lameck, Mithi claims that it is very surprising that although he is being accused of having no regard for the constitution, his colleagues were the first to breach the same document he is alleged to have violated.
“To illustrate this point one actually notices that your decision to suspend the chairman is not in line with the constitution.
“It is very sad to note that you have made very serious, baseless, malicious and defamatory allegations against the chairman without investigations. In very simple terms your accusations are just mere fabrications,” reads part of the letter addressed to the five members.
The letter further challenges the five to produce evidence to support their claims.
“Your conduct is therefore generally unlawful and is unconstitutional and it might end up breaking the league, which should not be tolerated.
“The chairman’s position is that he is totally innocent as regards all the allegations you have made against him. You are therefore required to unequivocally apologise to him and copies of that apology should be sent to all the individuals and organisations you made copies to,” further reads part of the latter.
It further warned that: “If you do not do the needful within the 14 days of the date of this letter, the chairman (Mithi) will not hesitate but take legal action against yourselves in your individual capacities without any notice whatsoever.”
Mithi was issued a suspension letter by his colleagues on January 16, accusing him of maladministration.
Part of the suspension letter read: “Of particular concern are your continued issuance of unilateral directives and derogatory remarks thrown at your fellow league members.
“You seem to have very little or no regard for the constitution governing football development and the welfare of your colleagues in the league. Consequently there is total loss of confidence in your leadership which is full of controversies.
“After a lengthy discussion, members are left with no option but to suspend you indefinitely. The members will sit in the nearest future to elect a caretaker chairman to guide the league to election time,” it concluded.
