Two judges’ case starts: proceedings adjourned to January 16 | |

The Judicial Service Commission yesterday started an inquiry into allegations of misconduct and incompetence levelled against High Court judges Dunstain Mwaungulu and George Chimasula Phiri by Parliament. Ralph Kasambara, one of the four lawyers representing the two judges, said in an interview yesterday a meeting worked out rules of procedure before the matter proceeds on January 16, 2002. It was chaired by Judicial Service Commission chair Chief Justice Richard Banda. The commission initially set Monday to hear Mwaungulu and Chimasula Phiri’s cases after President Bakili Muluzi cleared their colleague High Court Judge Anaclet Chipeta of the same charges. Senior Counsel Modecai Msisha, his partner Temwa Nyirenda and Dean of Law at Chancellor College Garton Kamchedzera are the other lawyers representing the two judges, according to Kasambara. He said both Mwaungulu and Chimasula Phiri attended the meeting. Parliament in November this year petitioned Muluzi to remove Mwaungulu, Chimasula Phiri and Chipeta on grounds of alleged incompetence and misconduct in the execution of their duties. Muluzi, however, referred the case to the Judicial Service Commission, whose other members are a private lawyer, a magistrate, a High Court judge and a representative of the Civil Service Commission. |
