State drops corruption case against Mvula
by: Henry Chilobwe, 7/26/2005, 7:12:20 AM

The State has decided to discontinue former Shire Buslines boss Humphrey Mvula’s case in which he was charged with multiple counts of corruption including abuse of office.
Lawyer representing the State Alexius Nampota told the Blantyre Magistrate’s Court on Monday that he had received instructions from the Director of Public Prosecutions (DPP) Ishmail Wadi to file a notice of discontinuance of the case.
He did not give reasons for the DPP’s decision.
“I was informed by the DPP to serve you with the notice of discontinuance but there have been delays in writing the notice. I expect it to be ready this afternoon.
“With the discontinuance action the accused is supposed to be formerly discharged and to that effect I seek an adjournment to tomorrow for the formal discharge,” Nampota told Chief Resident Magistrate David Kadwa.
Mvula’s lawyers Viva Nyimba and Chimwemwe Kalua said they would raise their concerns on the State’s decision during hearing today.
“My Lord, much as the State has decided to discontinue the action, we still have some concerns which we will raise tomorrow when the certificate of discontinuance is formerly given,” said Nyimba.
Mvula was facing ten counts of corruption among them the purchase of his official vehicle valued at K13 million but which he allegedly bought at K800,000, the award of a contract to QAC Enterprise which allegedly belonged to his cousin to supply automobile spare parts and another contract to Monday Trading allegedly to the former Shire Buslines boss own company which was also supplying equipment to the company.
The same court in March acquitted Mvula’s cousin Qita Chimzimu Mvula, who was also accused of palm-oiling the bus-line’s boss to award his company a contract, on grounds that the Anti-Corruption Bureau failed to prove that Shire Bus Company was a public company.
