Kips to withdraw Bullets case
by Oris Chimenya, 11 October 2004 - 08:14:42
Blantyre-based Kips Restaurant which last week filed at the High Court lawsuit against BB for failing to pay an outstanding food bill of about K1.3 million have said they will withdraw the case.
The food suppliers have said they will soon contact their solicitors to advise them on the withdrawing.
Kips director Shaffique Giga said at his premises in Blantyre the shop has decided to withdraw the case because Bullets are their regular customers and that they understand the financial problems in which the Super League defending champions are.
“We understand their financial problems and they also approached us to deal with matter out of court and we will do that.
“They have promised to pay and last night, they were here and we served them on ngongole as well,” he said on Thursday.
The manager said the lawsuit was no longer a big issue and that Bullets are their good business partners.
But surprisingly, Bullets vice general secretary Ibrahim Patel received the news with shock wondering why the restaurant had decided to withdraw the case when nobody from Bullets approached them on the issue.
“Why are they withdrawing? Neither the club’s secretariat or any official approached them on the issue.
“The case should still be in court and we are not happy that they want to withdraw it,” said Patel.
He said if the restaurant withdraws the case, then it [Kips] will be responsible for the lawyers who Bullets have already hired for the case.
Patel’s remarks sharply contradict club chairman Hassam Jussab’s recent recommendation he aired in The Nation that the matter between the two parties be settled outside the court.
But records at the restaurant indicate that Wednesday, some Bullets members had food at the restaurant.
The financial problems of the Malawi’s Caf champions league ambassadors have forced them to come out of their shell and humble themselves before government pleading for financial help.
On behalf of government, Sports Minister Henry Chimunthu-Banda told the team government is willing to help but the latter’s financial involvement should be very little.
