Mvula sues Shire Buslines for benefits

Former Shire Buslines Chief Executive Humphrey Mvula, who dropped his case against government for unlawful dismissal on Tuesday, has dragged his former company to court, asking for a declaration that he is still an employee of the bus company.
According to case number 274 of 2004 which is at the Blantyre Industrial Relations Court in Blantyre, Mvula is arguing that he is still an employee of the bus company as chief executive because he has not received the termination of contract letter from the board of directors as required by the contract agreement.
He says the President of the Republic has no power to terminate his contract.
“The applicant’s (Mvula) employment is governed by ordinary rules of employment law and has nothing to do with public service,” says the application written by his lawyer, Precious Chirwa.
Chirwa is also asking the court to order the company to pay his client August and September salaries and contractual benefits.
“I ask the court to declare that failure to pay the applicant’s salary for August and September amounts to unfair and unsafe labour practices,” said Chirwa.
Shire Buslines Corporate Manager refused to comment on the issue.
“If the case is in court what else can we say? I do not want to be commenting in this case,” he said.
Mvula was dismissed from Shire Buslines by president Bingu wa Mutharika after he was arrested on corruption and fraud charges. He challenged his dismissal in court, describing it as unlawful.
He withdrew the case on Monday without giving reasons.
“Every litigant has the right to withdraw a case from the court at any time or any stage of proceedings without giving reasons,” said Chirwa.
