Former treasurer sues MCP

Republican Party (RP) treasurer general Stanley Masauli has taken his former party MCP to court where he is claiming K5.2 million ($48,148) he advanced to the party when it was in financial woes.
The High Court in Blantyre on Tuesday adjourned the matter to a later date to give enough time to MCP lawyer John-Gift Mwakhwawa to study the case.
The court was expected to hear an application for judgment on admissions on the matter which was filed by Masauli lawyers Bazuka & Company.
According to a statement of claim, Masauli wants K5,265,574.47 he gave the party by way of loans and interest from August 14, 2001 to the date of payment at the National Bank of Malawi base lending rate and 15 percent collection charges on the principal sum and interest.
Masauli is also claiming costs for the action.
An affidavit sworn by Masauli himself says he advanced loans to the party when he was an MCP member and this was admitted by the party through a letter from the then Treasurer general Hetherwick Ntaba dated August 15,2001.
“I was a member of the Malawi Congress Party (MCP) during which time I advanced loans to the party. The amount of these loans came up to more than K5,000,000.00 in August 2001. The accumulated loans now total over K5,265,574.47,” reads the affidavit in part.
Masauli says in the affidavit that there is a clear and unequivocal admission that MCP is owing him at least K5 million.
A letter from Ntaba dated August 15, 2001 acknowledges Masauli’s various loans to the party in the excess of K5 million.
“There is no immediate hope that the party can pay you back this amount at the moment due to its financial constraints. However, we should be able to pay you back in sizeable instalments from the next parliamentary funding,” reads the letter in part.
