Government refuses to reinstate civil servant

The Malawi Human Rights Commission (MHRC) has instituted investigations into allegations that government is refusing to reinstate a Karonga ADD horticulturist who was acquitted of theft by a court.
Obvious Jones Chinoko, a horticulture officer based at Chitipa RDP, has been depending on well-wishers to care for his family of six children and two dependants since September, 2002, when he was acquitted of the crime.
“Despite approaching the ADD and ministry headquarters with the court ruling, no one has paid any attention for two years. I feel this is dehumanising as I am finding problems to live without any pay when I was supposed to be reinstated,” said Chinoko in an interview.
MHRC Investigations Officer Charles Kasambala confirmed in a separate interview that the commission has taken up the issue.
Said Kasambala: “We are indeed conducting on-spot investigations because we feel the issue is long overdue. And if it is indeed true that some people within the government or ADD are blocking his reinstatement, it is a total violation of human rights.”
He added: “We will come up with a comprehensive report after our investigations and we will make recommendations to relevant authorities to make sure the complainant is out of his present predicament,” said Kasambala.
But Programme Manager for the Karonga ADD Emmanuel Ching’amba in an interview said he was not aware of the incident, saying he had just arrived from abroad.
He said: “I will check with our Human Resources Department and I will come back to you. There is always a procedure that is followed in reinstating an interdicted employee, I am yet to establish if it was followed”.
