Justice minister’s bankruptcy case has two files

There is confusion surrounding a bankruptcy case involving Minister of justice Paul Maulidi with revelations on Tuesday that there are two court files for the same case.
Maulidi’s lawyer Maxwell Tembo told High Court Judge Justice Dunstain Mwaungulu in his chambers on Tuesday that there is a mix-up on the case files of the case.
Tembo said he indicated that he was going to defend a bankruptcy notice against Maulidi on January 23 but did not attend the proceedings because he was away attending a funeral.
“When I came back, I searched for the court file and there were indications that the matter was not heard and by this time I had already prepared a notice of adjournment and I was given the date of February 6,” said Tembo.
He said he noticed that there are two case files in the case when he filed an application to set aside bankruptcy proceedings and said it would only be fair to adjourn the matter until all the irregularities were taken care of.
Sydney Ndembe, through lawyer Yambani Mulemba, filed for bankruptcy proceedings against Maulidi after the minister failed to settle a debt amounting to K362,406.75 ($3,356) as rental arrears.
Mulemba also told Mwaungulu that they need to adjourn the matter to sort out the irregularities before proceeding with the case.
Mwaungulu adjourned the matter.
