Maulidi faces bankruptcy
by Pilirani Semu-Banda, 28 August 2003 - 18:14:15
Minister of Justice Paul Maulidi is facing bankruptcy following proceedings instituted in the High Court by Sydney Ndembe, who is claiming that he was Maulidi’s landlord and that the minister has failed to pay him K362,406.75.
Court records dated August 20, 2003 indicated that Maulidi has not paid any money to Ndembe despite a High Court ruling made on July 31, 2003 which ordered the minister to pay back the money.
The records indicated that the High Court had ordered that all the money in Maulidi’s account at National Bank of Malawi, Churchill Road Branch, not exceeding K362.406.75 be paid to Ndembe.
But a written affidavit, presented to the court by Ndembe’s lawyer, Noel Chalamanda, said that “to the best of my information and belief” some funds are held by National Bank of Malawi for Maulidi but that the sum of money in question still remains unpaid.
The records on bankruptcy proceedings also indicated that Maulidi is expected to pay back the money within seven days from August 20 or challenge the proceedings in the same period.
“You are especially to note that the consequences of not complying with the requisition of this notice are that you will have committed an act of bankruptcy on which bankruptcy proceedings may be taken against you,” stated the court records.
But Maulidi’s lawyer Meyer Chisanga said in an interview Thursday that his client does not agree with the case against him.
“I have a note from Honourable Maulidi which says that he does not agree with the case,” said Chisanga.
He did not elaborate.
