High Court judge Dunstain Mwaungulu on Friday granted an order to a concerned citizen Sam Mlanjira stopping the implementation of Parliament’s directive banning Big Brother Show on Television Malawi.
Mwaungulu’s order is directed at Speaker of the National Assembly Davis Katsonga, Television Malawi Director General Benson Tembo, Malawi Communications Regulatory Authority and information Minister Benard Chisale.
Mlanjira’s lawyers Noel Chalamanda and Yambani Mulemba told Mwaungulu that Parliament did not have any mandate to ban the show as there was no bill on the matter.
The two lawyers, from Knights and Knights legal firm, said Parliament did not consult with the public before effecting the ban.
By banning the show, Chalamanda and Mulemba, said Parliament fleeced people’s constitutional rights to free information and participation in cultural issues of their choice.
“The constitutional duty of Parliament is to pass laws, not to make orders,” said Chalamanda.
“The ban in not law and [President Bakili] Muluzi did not assent to it.”
Before Parliament rose on August 5, 2003 it banned the show from the local television station, alleging it is immoral.
