Whitex case battle starts |

The Blantyre High Court on Friday decided to hurry the hearing of a case where David Whitehead and Sons (DWS) employees are challenging the discharge of the injunction which stopped the Privatisation Commission (PC) from going ahead with the handover of the company to Mapeto Wholesalers.
DWS lawyer Chipiliro Luhanga questioned the reasoning behind the High Court’s decision to hold an interparte hearing on the wrangle surrounding the sale of the company if the handover of the company is going ahead before the court solves the matter.
Luhanga said it would not be fair to the employees if the court hears the matter after the handover has already been made.
“This is a matter of urgency. What purpose will the interparte hearing serve then?” queried Luhanga.
The query made Judge Dunstain Mwaungulu, who discharged the injunction granted to the employees, to move the hearing from Wednesday to Monday but Luhanga indicated that she was not ready yet with her papers ion the matter and suggested that the case be heard on Tuesday morning.
Whitex employees, led by their bosses including Chief Executive Evelyn Mwapasa, challenged the sale of Whitex to Mapeto Wholesalers, saying the company should have been sold at K300 million and not at K70 million as recommended by the PC.
