The Forum for the Defence of the Constitution (FDC) said Thursday it will continue pursuing the case in which it is challenging an injunction barring it from holding demonstrations.
Ian Nankhuni, who took the matter to court on behalf of FDC after the group was stopped from holding a demonstration against President Bakili Muluzi’s third term bid, said there was need for the court to clarify the issue of demonstrations.
Nankhuni said in an interview FDC met on Wednesday afternoon and agreed to proceed with the case although Muluzi has indicated that he will not seek re-election after anointing Bingu wa Mutharika to succeed him.
He said the FDC cannot demonstrate now because of the injunction.
Nankhuni said there are some issues which might need people to demonstrate and the issue must be settled now.
“The court has been waiting for us to indicate whether we’re still pursuing the case or not and we will be going there to tell the motion judge available that we will still pursue it,” said Nankhuni.
Former Attorney General Henry Phoya was granted an injunction to stop the FDC from holding week-long national protests in February.
High Court judge William Hanjahanja failed rule on the case after FDC asked him not to handle the case, saying he could not do so fairly.
The case is yet to restart, according to court records.
