42 months IHL for attempting rape |

The Mzimba First Grade Magistrate’s Court last week sentenced two men to 42 months imprisonment with hard labour (IHL) each for attempting to rape a 15 year old girl last month.
Police prosecutor Guency Luhanga told the court that the girl was coming from her grandfather’s house where she had gone to collect money for school fees.
Luhanga said the two suspects, John Moyo, 20, and France Chimaliro, 19, followed her and started taking to her.
The two then dragged the girl and forced her to lie down.
They tore the girl’s underwear but before they could rape her, an unidentified woman came to her rescue upon hearing the girl scream. The two young men ran away but Moyo left his shoes on the scene which together with underwear was tendered as evidence in court.
Delivering his ruling, magistrate Chakaka Nyirenda described the act as inhuman.
Nyirenda gave the sentence to deter would be offenders from indulging in similar acts.
In mitigation, the two pleaded for lenience, saying they had just married and had big families to look after.
However, Nyirenda dismissed the mitigation saying the two would have thought of their problems before committing the crime. |
