Kaliati sued

Minister of Information and Tourism Patricia Kaliati has been sued for allegedly threatening to take unspecified action against Miririana Osman whom she suspected of having an affair with her husband.
According to a High Court of Malawi affidavit Civil Cause Number 145/07, the first applicant Zexwell Osman, husband to Miririana and the lady herself as second plaintiff are suing Kaliati for making anonymous phone calls to them and pausing as a Mrs Phiri who demanded a meeting with Miririana for business transactions.
The affidavit, signed by the Osman’s lawyer Gift Nankhuni, shows that on January 31, 2007, Miririana received a call from Kaliati who accused her that she (Miririana) was having an affair with her husband.
“On February 1, 2007, the plaintiffs reported the matter to Balaka Police and the police facilitated a meeting between Mrs Phiri [who turned out to be Kaliati] and a person unknown to police officers at Balaka. The meeting was held in the presence of Balaka Police Sation officer in-charge and criminal investigations officer, who advised the plaintiffs not to take the matter far,” reads the affidavit.
The affidavit further says on the evening of the same day, Kaliati is said to have called Miririana again threatening to deal with them while claiming to know her whereabouts.
Nankhuni said in the affidavit that his clients are living in fear and have been contemplating of leaving the country for their safety saying they are not connected in any way to the allegations made against them.
“Wherefore I pray that this honourable court should order that the defendants by themselves or however acting be restrained from threatening and intimidating the plaintiffs with unspecified action until the final determination of this matter,” said Nankhuni in the affidavit.
Miririana who is a Burundi national says Kaliati claims to have seen her on January 14, 2007 with her husband at Balaka Hospital where her child was admitted.
According to court records, the case which was supposed to be heard at the Lilongwe High Court on February 21, 2007 has been shifted to Zomba High Court for proceedings.
